1. Scope and provider

These terms and conditions apply to orders placed by consumers in the BrickFacewear online shop at brickfacewear.com.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Ordering and conclusion of contract

The presentation of products in the online shop does not constitute a binding offer.

You can add products to the cart without obligation. Before submitting your order, you can review and change the selected items, variants, quantities and your details.

By clicking the final order button, clearly labelled as an order with an obligation to pay, you submit a binding offer to purchase the goods in your cart.

An automatic email that merely confirms receipt of your order does not constitute acceptance. The contract is concluded when we expressly accept your order, ship the goods or capture the payment. A mere payment authorisation does not count as capturing the payment.

We accept orders no later than five calendar days after you place them. If we do not accept within this period, you are no longer bound by your offer.

3. Contract language and order documents

The contract language is German or English, depending on the language in which you place your order. If there are discrepancies, the German version prevails, unless mandatory consumer protection law of your country provides otherwise.

You can save these terms using your browser's save or print function. We will send you the order details and these terms on a durable medium, for example by email, no later than upon delivery.

4. Prices, bundle prices and shipping costs

The prices shown at the time of your order apply, in the currency displayed.

All prices are final prices including statutory VAT. Shipping costs are shown at checkout before you complete your order.

Bundle prices apply to BrickFace masks: two masks cost €49.99 together, three masks €69.99. The bundle price is calculated automatically in the cart, applies once per order and cannot be combined with other discount codes.

5. Payment

The available payment methods are shown in the shop and at checkout. Availability may depend on the destination country and the payment provider. The time of payment depends on the selected payment method. For payments via external payment providers, their terms for payment processing, available at checkout, also apply.

6. Delivery

We deliver to the address you provide. Delivery countries, shipping costs and delivery times are listed in our shipping policy and at checkout. For deliveries outside the EU, customs duties and import charges may apply, which are borne by the recipient.

If we become aware of delays, we will inform you. Your statutory rights in the event of late or non-delivery remain unaffected. Even if a fulfilment partner delivers the goods directly to you, BrickFacewear – David Kreik remains your contractual partner.

7. Right of withdrawal and returns

Consumers have a statutory right of withdrawal. Details on how to exercise it, the deadlines and the consequences are set out in our returns and refund policy. You can also withdraw online via the “Withdraw from contract” page.

If you withdraw, you bear the direct cost of returning the goods. This does not apply to returns required as part of a justified statutory warranty claim.

8. Warranty

The statutory warranty rights apply. If an item is defective, damaged or incorrect, please contact us using the details above. Not reporting immediately or not providing photos does not limit your statutory rights.

9. Liability

We are liable in accordance with the statutory provisions. These terms do not limit statutory liability.

10. Data protection

Information on how we process personal data can be found in our privacy policy.

11. Final provisions

Individual agreements take precedence over these terms. Mandatory consumer protection rights remain unaffected. If any provision of these terms is invalid, the statutory provisions apply in its place.
